专利文件是法律与技术的综合体,在翻译专利文件要同时从技术和法律两方面综合考虑。一方面,技术上,将专利申请的技术方案准确、清楚、完整地再现成另一种语言。另一方面,法律上,使专利获得最大程度的保护,同时满足专利法对清楚问题、支持问题、说明书公开充分等要求。本文讨论了专利文件翻译的原则:直译原则、等价原则、保护范围最大化原则、准确原则、专业原则、一致性原则、区分原则、语句完整原则。在所有的翻译原则中,直译为专利文件翻译最根本的原则。

A patent document is a combination which integrates technical and legal,and is translated in view of technical and legal.On one hand,for technical,the technical solutions of the patent application are exactly,clearly,and intactly reproduced into another language technical.On the other hand,for legal,the right of the patent is protected with the broadest scope,while the definiteness,the support,and the insuffi cient disclosure of the description according to patent law are met.This article discusses translation principles of patent documents:literal translation,equivalence,broadest scope,exactness,professional,consistent,differentiating,intactness of sentence.Among these translation principles,the literal translation is the most important principle of the translation of patent documents.
