摘要 将法学本科实践教学置于国家统一法律职业资格考试制度所强调的专业与实践视域下来审视可知,由于案例分析、模拟法庭、专业实习这三种实践教学形式在相当程度上被弱化而没有发挥其应有的训练场功能、演习场功能和主战场功能。基于应用型法律创新人才的培养目标,以提升法科学生职业技能为根本目的,构建法学本科"三维"实践教学模式:基础性的案例分析、体验性的模拟法庭和实战性的专业实习。这一以递进、交叉、融合为特征的立体化实践教学模式在制度层面和操作层面的展开必将提升法科学生的职业技能,为培养应用型的法律创新人才做出基础性贡献。 Practice the teaching of law undergraduates under the professional and practical perspective to look down,in the national unified legal professional qualification examination system,case analyzing,moot court,professional practice,these three forms of practical teaching has been weakened to a certain extent,and did not play it’s training function,exercising function and the main battlefield function.Based on the training objective of applied law innovation talents,in order to form and improve the professional skills of law students as the fundamental purpose,the practice teaching mode of legal undergraduates course is defined as three dimensions:basic case analysis,experiential moot court and authenticity of professional practice.Thethree-dimensional practical teaching models which are characterized by progressive,intersecting and merging at the institutional level and the operational level.It will enhance the professional skills of law students and make a fundamental contribution to the cultivating applied legal innovation talents.
