农村集体建设用地流转机制研究

Research on the Transfer Mechanism of Rural Collective Construction Land

中国城乡二元矛盾凸显,农村发展陷入经济聚集效益弱、建设发展滞后的困境,遂中国新型城镇化发展强调聚焦乡村、关注"三农",旨推进城乡一体现代化。文章首先梳理了新中国成立至21世纪后中国农村集体建设用地的发展进程。在分析相关研究现状之后,提出构建"因素层—行动层"的解析框架来对农村集体建设用地流转机制进行系统化分析,针对性提出现行农村集体建设用地流转机制存在的缺乏基础需求考量、完善补偿制度、统一土地管理等三大发展误区,建议在坚持城乡结合、降低发展成本及规范土地市场的总思路下采取落实民生福祉、激励约束并存与构建网络化管理平台的发展策略。由此,为未来农村集体建设用地流转机制研究提供思路。

The dual contradictions between urban and rural areas in China are highlighted,and rural development is immersed in the predicament of weak economic accumulation and lagging development in construction.The development of new urbanization in China emphasizes the focus on rural areas and focuses on"three rural issues"and aims to promote the modernization of urban and rural areas.First,the process of the development of China's rural collective construction land after the establishment of the New China to the 21st century is reviewed.After analyzing relevant research status,the paper proposes to construct an analytical framework of"factors and action levels"to systematically analyze the mechanism of rural collective construction land transfer,and proposes the lack of basic needs for existing rural collective construction land transfer mechanisms.To improve the three major misunderstandings of the compensation system and the unification of land management,it is proposed to adopt the development strategy of implementing people's well-being,incentives,and coexistence and building a networked management platform while adhering to the integration of urban and rural areas,reducing development costs,and planning the land market.Therefore,it provides ideas for future research on the circulation mechanism of rural collective construction land.
