自然资源保护生态补偿法律机制研究

On the Legal System of Eco-compensation for Natural Resources Conservation

具有外部性内化功能的生态补偿制度有助于平衡自然资源的经济价值与生态价值,是中国自然资源保护制度建设的关键。中国自然资源保护生态服务政府补偿和市场补偿在实施过程中均存在障碍,目前最重要的是制定《生态补偿法》,统筹好政府和市场、中央政府和地方政府的关系,构建起保障生态服务受益者付费、建设者和保护者得到合理补偿的良性运行机制。

The eco-compensation system which has the function of internalizing externalities is helpful to balance the economic value and the ecological value of natural resources,hence the key to the construction of China’s natural resources protection system.However,there are some obstacles in the enforcement of both governmental and market eco-compensation policies.What should be done first is to formulate the eco-compensation law,to coordinate the relationship between government and market,and between the central government and the local government,and to establish a well-functioning mechanism which can make ensure that those who benefit from ecological service should pay for what they get and those who build and protect the ecology should get reasonable compensation for what they give.
