摘要
《网络预约出租汽车经营服务管理暂行办法》规定网约车平台承担承运人责任,但其忽略了网约车运营模式的多样性。在私家车模式下,将网约车平台与驾驶员之间的关系认定为劳动关系是不适宜的,二者不具有从属性。根据"运行支配和运行利益"相结合的二元理论确定网约车平台属于《中华人民共和国道路交通安全法》规定的"机动车一方",在第三人遭受损害时,网约车平台和私家车车主承担连带责任。
Interim Measures for the Administration of Internet Private Hire Vehicles Management Services says that the online car-hailing service platform should bear the responsibility of the carriers,but it ignores the diversity of the operating model of the network.Under the mode of private car sharing,it is improper to confirm that there is a labor relationship between the two parties,and there exists no subordination.According to the dualistic theory of“operation control+operation interests”,it is a good way to treat the platform as the side of motor vehicle.When the third person suffers damage,the platform and the driver should be both responsible for the joint liability.
