论我国死刑复核程序的改革与完善

死刑复核程序是处理死刑案件的最后一步,也是最重要的一步,是由最高人民法院来核准死刑的一种特殊的程序。死刑复核程序必须具有尊重被告人生命权、及时纠错、符合法律规定等作用。死刑是刑罚中最严格的一种,关乎着被告人的生死问题,所以死刑复核程序的影响极其重要。因此,本文从死刑复核存在的问题着手,探讨和研究死刑复核程序的改革与完善。

The death penalty review procedure is the last and most important step in the handling of death penalty cases.It is a special procedure for the death penalty to be approved by the Supreme People's Court.The death penalty review procedure must have the effect of respecting the defendant's right to life,timely correction,and compliance with legal requirements.The death penalty is the most stringent one of the penalties,which is related to the life and death of the accused,so the impact of the death penalty review procedure is extremely important.Therefore,starting from the problems of the death penalty review,this paper explores and studies the reform and improvement of the death penalty review procedure.
