摘要
我国农村集体经济组织的法律定位一直不明确,给理论和实践带来一定程度的障碍。文章分析了农村集体经济组织面临的现实困境,认为应将其视作企业法人。然后探讨了该情形下具体的治理结构,并对该模式如何适应农村实际情况提出立法建议。
The legal status of the collective economy organization in China’s rural areas is not clear,which makes an obstacle theoretically and practically.The realistic dilemma they are facing is analyzed.It is claimed that they should be taken as business entity.The governance structure in this circumstance is discussed with suggestions on how this model adapts to the practical situation.
