论述了我国值班律师制度的建立,分析了其在实现刑事司法公正,保障犯罪嫌疑人、被告人的权利方面的优势。通过与英国值班律师制度相比较,认为在提供服务的无偿性、服务范围和对象的广泛性等方面存在相同之处,但在值班律师准入资格、援助申请程序、服务形式等方面都有所不同。我国值班律师制度的发展必然要经历出现问题、分析问题、解决问题的过程。在分析、解决问题时,应借鉴域外特别是已形成完善值班律师制度国家的经验,进一步明确我国值班律师具体实施模式,结合时代发展趋势及各地不同实情提出改进措施,以促进我国法律援助值班律师制度的不断完善。

This paper expounds the establishment of the duty counsel system in China?analyzes its superiority in realizing criminal justice and guaranteeing the rights of suspects and defendants.Compared with on duty counsel system in Britain,there are similarities in the free of service,the scope of service and the universality of the object,but there are some differences in the qualification of the lawyer on duty,the procedure of application and the form of service.The development of duty counsel system in China must go through the process of problems,analysis and problem solving.In analyzing and solving problems,we should learn from the experience of foreign countries'especially those who have formed a perfect duty counsel system,further clarify the specific implementation mode of our duty counsel,combine the development trend of the times and the different facts to put forward some improvement measures to promote the continuous improvement of our legal aid on duty lawyer system.
