个人信息保护的法律困境及其对策

个人信息已成为重要的生产资料,然而由于技术不够完善和立法、执法未能及时跟进等原因,个人信息被大肆的侵犯,严重影响了公民的人身和财产安全。为了平衡数据挖掘与个人信息安全的关系,应当尽快建立健全个人信息保护制度,完善个人信息的收集、处理、管理、使用、删除和救济等规则,并将个人数据进行去身份处理,降低个人信息在流通中的隐私风险。同时,还应尽快完善个人信息被侵犯后的应急措施和法律责任等制度,导入保险与惩罚性赔偿制度,为受害人提供切实可靠的救济途径,矫正当前个人信息挖掘无序的状态。

In the era of big data,personal information has long been an important means of production.However,due to the inability of technology and legislation,the law enforcement failed to follow up in time and other reasons,resulting in the current massive infringement of personal information,seriously affecting citizens’personal and property safety.In order to balance the relationship between data mining and personal information security,the personal information protection system should be established and perfected as soon as possible so as to improve the rules for the collection,handling,management,use,deletion and relief of personal information,and to handle the personal data as personal identity and reduce the personal information privacy risk in circulation.At the same time,systems such as the prohibition of tracing of sources,emergency measures and legal responsibilities should also be improved as soon as possible so as to provide victims with credible relief channels and correct the current chaos caused by the abuse of personal information.
