摘要
当前中国城市小区治理面临着重重矛盾和问题,已经影响到城市基层社会的秩序。城市小区治理的现实困境反映了理论认识的混乱,集中表现为围绕住宅小区内部究竟是小区还是社区、是私人的集体空间还是国家的公共空间、是业主集体治理还是国家治理,以及小区自治是业主自治还是居民自治等问题产生的分歧。在市场经济时代,基于财产所有权的业主自治是市场经济的必然要求,尊重业主自治意味着尊重市场经济规律。业主自治起决定性作用,居民自治起支持和辅助作用,基层党组织和政府发挥指导、监督、保障作用和承担公共管理职能,形成多元共治的局面,是化解城市小区治理困境的关键。
At present,the governance of urban residential areas in China is faced with many contradictions and problems,which have affected the order of urban grass-roots society.The realistic governance predicament of urban residential areas reflects the confusion of theoretical understanding,whether it is a community or a quarter within the residential area,the private collective space or the public space of the state,the house owners’collective governance or state governance,and the autonomy of the house owners’or the autonomy of the residents’,etc.In the era of market economy,house owners’autonomy based on the property ownership is the inevitable requirement of market economy.
