房屋共享外部性影响的法律规制

摘要 共享房屋具有较大的外部性影响,其占据社区公共资源,不安全因素较多;尚不健全的信息信用体系影响他人选择;冲击传统市场,影响社会公平;平台性质的认定带来税收监管问题。把握对其规制时应秉持公平和鼓励的原则,探讨应限制房屋共享时间,弥补公共设施损失;加强平台信息信用建设,提升不同主体间的信任;促进平台与原企业正当竞争,完善社会公平机制以及强化税收规定,对其进行税收,以此提高共享房屋领域的外部认可度。 Shared housing has a large external influence,which occupies public resources of the community and causes more unsafe factors;The unsound information and credit system influence others’choices;Sharing economy shocks the traditional market and affects social equity;The identification of the nature of the platform has caused the problems of tax supervision.Thus,we need adhere to the principle of fairness and encouragement,restrict the time of sharing house and make up for the public facilities in its regulation;enhance information and credit developments of the platform as to promote trust degree of the different parts;promote fair competition between the platforms with original enterprises and perfect the system of social justice,and we also need to enforce taxes in case someone takes advantage of the law.To improving its social approval degree by the measures above.
