论司法信息公开与公众参与司法的关系

On the Relationship Between the Disclosure of Judicial Information and the Public Participation in Judicature

司法信息公开的本质是信息透明,目的是解决公众参与司法面临的信息不对称问题;反过来,公众参与司法也能倒逼司法机关的司法信息公开,尤其是提升司法信息公开的效率和质量。良性互动中的司法信息公开和公众参与司法是提升我国司法民主水平的关键,两者不可偏废其一。为此,司法信息公开必须是及时公开、精准公开,增加公众话语在司法信息公开考核机制中的权重;司法公众参与必须有序有效,优化司法公众参与的责任制,统筹体制内和体制外司法公众参与者责任。

The essence of judicial information disclosure is information transparency,whose purpose is to solve the problem of information asymmetry in public participation in the judiciary partice and enhance the public's ability to participate in the judiciary partice.In turn,public participation in judicature can force judicial information disclosure of judicial organs,especially improve the efficiency and quality of judicial information disclosure.It can be said that the disclosure of judicial information and the public participation in judicature in positive interactions are the key to improving the level of judicial democracy in China,and the two cannot be neglected.Therefore,judicial information disclosure must be timely and accurately open,and increase the weight of public voice in the judicial information disclosure assessment mechanism.Judicial public participation must be orderly and effective.The responsibility mechanism of judicial public participation should be optimized,and the responsibility of public participants should be coordinated with in and outside of the system.
