身份识别:我国运动员职业纠纷解决的关键所在

Identification:Key to Resolution of Professional Disputes of Chinese Athletes

身份指个体在某一群体或社会中某一确定的社会位置。作为一种调整方式,以"身"定"份",古已有之。在当下我国运动员身份重构日趋迅捷的时期,通过身份识别,厘清运动员职业纠纷中运动员与其它体育主体之间的权利义务关系,不失为一条顺利解决纠纷,促进体育秩序稳定的新思路。研究从我国运动员身份的变迁历程入手,分析运动员职业身份的本质特征,讨论了运动员职业纠纷中涉及的身份法律性质问题、多重身份规范适用不确定性问题和身份权利与身份义务关系问题,认为可以通过身份识别提升运动员的身份认知能力,避免纠纷发生;以正确识别运动员身份为基础,可实现纠纷的顺利解决。

Identity refers to a certain social position of an individual in a group or society.As a means of determining one’s status,it has existed ever since the ancient times.At the present time,when the status reconstruction of the athletes in China is becoming more and more rapid,clarifying the rights and obligations between athletes and other sports subjects in the professional disputes of athletes is a new way to resolve disputes smoothly and promote the stability of sports order.This study analyzes the changing process of the Chinese athletes’identity,the essential characteristics of the athletes’professional identity,the legal nature involved in athletes’professional disputes,the uncertainty of the application of multiple identity norms and the relationship between right to identity rights and duty of identity.The research suggests that the athletes’cognitive ability can be improved through identification to avoid disputes.Based on the correct identification of athletes,the dispute can be resolved smoothly.
