我国基因隐私权保护问题初探

Preliminary Study on Genetic Privacy Protection in China

人类基因信息包含着人的众多隐私,在基因检测技术越来越先进的时代,基因隐私权亟待法律保护;我国对于基因隐私权的保护,至今没有系统的法律体系来规范,本文乃在考察美国有关立法的基础上提出采用专门立法模式、在立法中采用禁止性的规定、重视基因隐私权在特定领域的保护等建议,来实现对基因隐私权的有效保护。

Human genetic information contains a lot of privacy,in the era with more and more advanced gene detection technology,the privacy of genes urgently needs legal protection.Compared with the United States,China lags behind in the protection of gene privacy,and there is still no systematic legal system to regulate it.Based on the investigation of the American legislation on the protection of personal genetic information,this paper puts forward some suggestions such as the adoption of special legislative model,the adoption of prohibitive regulation in the legislation and the emphasis on the protection of gene privacy right in specific fields,etc.to achieve the effective protection of gene privacy.
