我国行贿犯罪刑事政策的执行现状分析及完善对策

An Analysis of the Executive Actualities about the Bribery Criminal Policy in China and Improvement Measures

近年来,我国对行贿犯罪的刑事政策开始向"加大惩治力度"和"惩治受贿与行贿并重"的方向转变。这种转变也在我国关于行贿犯罪的立法中得到了体现。不过从我国当前司法实践中对行贿犯罪的惩治力度和刑事责任强度来看,这种变化并未得到充分的体现,因而现阶段需要采取相应的完善对策,保证行贿犯罪的刑事政策能够在司法实践中得到贯彻落实。

In recent years,the criminal policy about bribery crime in China transforms to"strengthening criminal punishment"and"laying equal stress on bribe-taking and bribery crime",which is embodied in legislation about bribery crime.However,according to the degree of punishment and strength of criminal policy about bribery crime in juridical practice,the variation is not reflected obviously.So at the present stage,it is necessary to take improvement measures to ensure the implementation of bribery criminal policy in juridical practice.
