未经许可演绎创作涉及了两个行为,即侵权行为和创作行为,产生了两个法律关系。侵权事实的存在,并不影响未经许可创作的演绎作品依法取得完整著作权。此外,授予演绎人以完整著作权,并不意味着授予其擅自对其作品实施受著作权控制的行为的权利,进而损害原作品著作权人的利益。

Unauthorized derivative creation involves two behaviors,namely,infringement and creation,whereby generating two legal relationships.The fact of infringement does not deprive the full copyright of derivative works created without authorization.However,granting full copyright to the author of derivative works does not mean to grant him the right to exercise and harm the original author's exclusive copyrights.
