环境保护限停产的法治化:适用情形、实施程序与监管措施

On Rule of Law of Restriction Production and Suspend Operation of Environmental Protection:Application Situation,Implementation Procedure,and Regulatory Measures

2014年《环境保护法》修订,第60条规定环境保护限停产取代之前的限期治理,进而通过部门配套规章、环境保护单行法修改等初步形成环境保护限停产法律规范体系,但在适用情形、实施程序与监管措施方面存在较多问题。我国应当对环境保护限制生产和停产整治的适用情形予以区分,但各环境保护单行法应当予以统一,并且明确规定适用的例外情形。我国环境保护限停产应当建立前置程序、细化期限规定和完善决策程序,以完善实施程序规范。同时,环境行政主体对排污者实施环境保护限停产后的整改情况负有监管职责,应当加强责令后的督察、解除后的跟踪检查,以及健全与之并处的行政处罚。

The environmental protection law was revised in 2014,and restriction production and suspend operation of environmental protection were stopped before the replacement of the time limit,and then the legal system of the restriction production and suspend operation of environmental protection were formed through the department rules and the amendment of the environmental protection single line. However,there are many problems in the application situation,implementation procedure and supervision measures. The application of environmental protection to restrict production and stop production should be distinguished,but the unilateral law of environmental protection should be unified,and the applicable exceptions should be clearly stipulated. The rule of law for restriction production and suspend operation of environmental protection should establish a pre procedure,specify the time limit and improve decision-making procedures,so as to perfect procedural norms. The rule of law of restriction production and suspend operation of environmental protection should strengthen the post-supervision,the following up inspection and the perfection of the fine and credit penalty.
