法经济学作为一门法学与经济学交叉的学科,通过经济学的理论能够有效分析法律现象及法律行为。诉讼作为解决纠纷的一种方式,随着社会的不断发展,在日常生活中越发常见。诉讼相比其他纠纷解决方式而言,可以获得较公正的裁判,但是由于耗时长,当事人所耗费时间、精力过多,从而让很多当事人望而却步。对诉讼成本的具体内容进行法经济学分析,并对比我国现存的诉讼成本的情况与外国诉讼成本的负担情况。针对不同情况提出缩减诉讼成本或增加诉讼成本的措施,有利于提高诉讼效率,促进纠纷的解决。

As a discipline of law and economics,law and economics can effectively analyze legal phenomena and legal behaviors through the theory of economics.Litigation as a way to resolve disputes,with the continuous development of society,is more and more common in daily life.Compared with other dispute resolution methods,litigation can obtain more fair judgments,but due to the time-consuming,the parties spend too much time and energy,which makes many clients discouraged.By analyzing the specific content of the litigation costs through the method of law and economics and combining the current situation of the litigation cost in our country with the burden of the litigation cost in foreign countries.We can put forward the measures to reduce litigation costs or increase litigation costs under different circumstances to improve litigation efficiency and promote the resolution of disputes.
