中国治理现代化的突出问题与法治进路

The Obstacles and Transition toward Modernization of Governance idea in China

国家治理体系与治理能力现代化要求治理理论的重塑。这一任务面临一些观念障碍:国家至上观念对社会治理的侵蚀;中央集权对地方治理的限制;内向性传统对全球治理的忽视。要从如下方面推进治理变革,促进治理观念的革新:推进社会治理,弥补国家治理之不足;改善央地权力配置,发挥地方治理的积极性;改变内向性心态,提升中国对全球治理体系之参与塑造能力。应当以法治思路促进从"统治"向"治理"的观念转型,借鉴辅助性原则,建立各方共治共享的治理体系,推进国家治理体系与治理能力现代化。

Modernization of national governance system and governance capability requires remodeling of governance theory and rule of law of theory.This task faces some main obstacles:the loser society under the state supremacy;the weaker local governments under the centralization;and the neglect of global governance with the traditional idea.We should promote governance reform and innovation of governance idea in the following aspects:promoting social governance to help the national governance;improving the allocation of power between central and local governments for local governance initiative;changing introverted mentality to enhance China's ability to participate in the global governance system.By transforming the concept of“government”to“governance”,and learn from the principle of subsidiarity,we can establish a governance system shared by all parties to promote the modernization of national governance system and governance capacity.
