网络证据在专利审查中的应用探讨

Discussion on Application of Network Evidence in Patent Examination

目前的专利审查工作中存在网络证据有效性判断标准不易把握的情况,本文结合三件具体案例,论述了对网络证据的有效性进行判断的方法。本文认为,应从网络证据的合法性、网络证据的稳定性和网络证据的来源对网络证据进行考量,从而判断网络证据是否有效。

In patent examination practice,the standard for judging the validity of network evidence is difficult to handle.The present article discusses how to judge the validity of network evidence in light of three specific cases.It is suggested that the legality,the stability and the source of network evidence should be considered in judging whether network evidence is valid.
