本文从一个具体案例出发,探讨了同一份文件中的不同技术方案之间是否具有创造性结合启示的问题。重点从技术手段和技术问题两个角度对不同技术方案进行了剖析,进而得出同一份文件的其他技术方案是否具有技术启示的判断标准,即要看同一份对比文件其他部分披露的技术手段,该技术手段在该其他部分所起的作用与该区别特征在要求保护的发明中为解决该重新确定的技术问题所起的作用是否相同。

This article starts from a case and discusses a problem whether there exists such a technical motivation between different technical solutions in the same document.Focusing on the analysis of different technical solutions from the perspectives of technical means and technical problem,and then inferred the judgment standard of whether the other technical solutions in the same document exist the technical motivation,that depend on the technical means disclosed in other parts of the same document,the role of technical means in the other part is the same as that of the distinguishing feature in the claimed invention for solving the redefined technical problem.
