The Basis and Path of the Validity of Legal Norms

法律事实有效性与规范有效性的张力问题是哈贝马斯法哲学著作《在事实与规范之间》的理论核心。因法律事实有效性具有强制性、可预测性,故法律规范有效性的构建便成为解决二者张力问题的关键。论文从法律合法性、法律的社会习惯、立法过程商谈三个方面构建法律的规范有效性,探讨何种法律能够具有强力的规范有效性,能够刻在公民内心。

The tension between the validity of legal facts and the validity of norms is the theoretical core of Habermas’ s philosophical work between fact and norm. Because the validity of legal facts is mandatory and predictable, the construction of the validity of legal norms becomes the key to solve the tension between the two. This paper constructs the normative validity of law from three aspects: legality of law, social habit of law and negotiation of legislative process, and discusses what kind of law can have strong normative validity, which can be engraved in the heart of citizens.
