劳动争议的有效化解是和谐劳动关系的保障。劳动领域的社会治理创新也应当坚持"共建共治共享""专业化""法治化"等理念。行业协会自身的特殊性使得行业协会介入劳动争议化解具有独特的优势,它是多元纠纷化解模式的重要组成部分。行业协会介入劳动争议化解机制的具体建构应涵盖规则、制度、程序和组织机构等层面的内容,它包括了四个相对独立的机制,即协商机制、协调机制、调解机制和监管机制。
The effective resolution of labor disputes is the guarantee of harmonious labor relations. The innovation of social governance in the field of labor shall also adhere to the concepts of “co-construct ion, co-management and sharing”,“specialization” and “legalization”. The particularity of guilds makes them enjoy unique superiority in resolving labor disputes. It is an important part of the multivariate dispute resolution pattern. The specific construction of guilds' intervention in labor dispute resolution mechanism shall cover rules, systems, procedures and organizations and include four relatively independent mechanisms, namely, consultation mechanism, coordination mechanism,conciliation mechanism and supervision mechanism.
