《核安全法》的若干看点

Research on Several Key Issues of China's Nuclear Safety Law

《核安全法》于2018年1月1日实施,因核工业特殊管理流程以及相当多的专业术语,增加了理解该法的难度。本文通过对主要核安全监督管理部门和被监管主体在该法中的定位和责权范围进行分析,对关键监管对象的核设施、核材料与放射性废物定义、调整范围和理解差异提示解读。同时说明在公众在该法中从知情到参与权的不同意义和立法意图,并就核损害问题的简化和立法空缺做了分析,以利对《核安全法》准确的理解。

Nuclear Safety Law has been enforced from January 1 st, 2018, because of the unique management process of the industry and plenty of professional terms, the understanding of the law becomes difficult. In this dissertation, the role,the rights and obligations of major nuclear safety regulators and the regulated was been analyzed, the key regulates of nuclear facilities, nuclear material and radioactive waste’s definitions,extents and understanding variation was explained. The public’s rights of information and attendance, as well as the intendance of rulemaking was introduced. In the end,analysis of simplify was made on nuclear damage liability issues and the improvement of rulemaking, so as to ensure accurate understanding on the Nuclear Safety Law.
