论刑事审判程序繁简分流的界定——基于程序繁简分流的划分标准、影响因素及运行模式的分析

刑事诉讼程序繁简分流的本质是程序正义在其最低限度实现的基础上,为了追求程序的经济性而将无必要保留的程序合成部分予以省略的诉讼程序样态。其分流的划分标准在于程序合成的繁杂程度;影响因素包括诉讼合意程度、当事人处分和实体正义实现的难易程度;上述三种影响因素间的组合会形成不同类型的简化性程序运行模式。我国的简化性程序模式具有类型单一、适用率低和非效率性价值因素较多等缺陷,需要通过改革简化性程序的条件和模式等措施予以完善。

The nature of the diversion of criminal proceedings is the pattern of contentious procedure which its procedural part of the procedural synthesis is not need to be retained in order to pursue the economics of the procedureon the basis of its minimum realization because of its procedural justice.The theoretical standard of its diversion lies in the degree of the complexity of program synthesis.Its influencing factors include the degree of litigation consensus,the difficulty of litigant punishment and the realization of substantive justice.The combination of the three influencing factors can form different types of simplification program operation mode.China s simplified procedural model has the shortcomings of single type,low application rate and inefficient value factor,which needs to be improved by reforming the conditions and modes of simplification procedure.
