The Deficiency and Improvement of the Exemption System of Monopoly Agreement in China

《反垄断法》适用除外制度确立有利于客观公正地评价垄断行为所具有的积极效应或消极后果,肯定必要的合理的垄断行为,适时协调竞争政策与产业政策的关系,有利于充分发挥《反垄断法》的积极作用,构建实质公平的竞争环境。基于此,分析我国《反垄断法》适用除外制度的现状及存在的缺憾,在我国《反垄断法》发展实践的基础上,借鉴国外的先进经验,提出完善我国《反垄断法》适用除外制度的相应对策。

The Anti-Monopoly Law(AML)system contains their own exemption system for AML.The establishment of exemption system is helpful to evaluate the positive effect and negative influence of monopolistic behavior in an objective and fair way.AML will give full play of the positive role when the rational monopolistic behaviors are applied in countries.To build a fair competitive environment;it is important to coordinate the relationship between the competition policy and industrial policy.Hence;this article will analyze the current situation and the deficiency of the exemption system of AML.Based on the practice and development of AML;we will take example by the experience of foreign countries.Besides;this article will give suggestions about the improvement to the exemption system of AML.
