基本医疗保险关系转移接续的法学思考

Legal Thoughts on Transfer and Continuation of Basic Medical Insurance Relations

享受医疗保险是公民社会保险权的题中之义。国家层面的规定对基本医疗保险关系转移接续只给出了原则性意见,地方规定又各有不同,参保人员跨地域、跨制度流动时,因无法可依导致不能连续参保、影响医保待遇享受。文章从法学视角出发,分析现行制度存在的问题及原因,并从依法治国角度,提出制定基本医疗保险关系转移接续制度的建议,以弥补现有医疗保障制度的设计缺陷,保障公民医疗保险关系转移接续有法可依,保障公民医保关系在制度间和地域间地顺畅流转,促进医保制度的完善和全民医保、公平医保的实现。

Enjoying medical insurance is the meaning of insurance rights in any civil society.Legislation issued by the central government only provides references for the transfer and succession of basic medical insurance relations in principle,while regulations of local governments differ from each other.When insured personnel move across regions and systems,they cannot continue to participate in insurance,which affects the enjoyment of medical insurance benefits.From the perspective of law,this paper analyses the existing problems and causes of the current system,and from the perspective of governing the country by law,it puts forward some suggestions on the formulation of the transfer and continuation system of basic medical insurance relations,in order to make up for the design defects of the existing medical insurance system,ensure that the transfer and continuation of citizen medical insurance relations can be legally abided by and the flow of citizen medical insurance relations between systems and regions be smoothly carried out,as well as promoting the improvement of the medical insurance system and the realization of national medical insurance and fair medical insurance.
