A Preliminary Analysis of the Legislation on Seawater Utilization Management

推进海水利用管理立法是生态文明建设的必然要求,具有重大的政治、经济和生态保护意义。同时,由于我国淡水资源稀缺、海水利用管理实践具备一定规模、既有立法对相关活动的规范缺失、海水开发利用活动具有特殊性,推行海水利用管理立法的必要性毋庸置疑。现阶段推进海水利用管理立法的条件基本成熟。在具体进行立法工作的过程中,可以考虑确立法律层级的立法,明确以自然资源主管部门牵头负责的管理体制,具体构建海水利用综合管理制度体系、海水利用环境保护制度体系以及海水利用产业促进制度体系。

Promoting the legislation of seawater utilization management is a necessary requirement of the ecological civilization construction,and has significant political,economic,and ecological protection significance.At the same time,due to the problems of scarcity of freshwater resources in China,the management practice of seawater utilization of a certain scale,the lack of regulation on relevant activities by existing legislation,and the specificity of seawater development and utilization activities,there is no doubt that it is necessary to implement seawater utilization management legislation.At present,the conditions for advancing seawater utilization management legislation are basically mature.In the process of specific legislative work,we should make seawater utilization management into laws rather than into regulations,set up a management system led by the responsible departments for natural resources management,and construct a comprehensive management institutional system for seawater utilization,an environmental protection institutional system for seawater usage,and an institutional system for the promotion of seawater utilization.
