证据裁判原则是以审判为中心的刑事诉讼改革的核心与关键,该原则与冤假错案防范和以审判为中心的刑事诉讼制度改革关联密切。证据具有客观理性、价值理性和程序理性三重特质,以证据为基础的证据裁判原则也因此具有主客观统一性、价值理性和程序理性三重特性。证据裁判原则的三重特性共同作用,确保其在以审判为中心的刑事诉讼制度改革中发挥着既相互独立又有机统一的三种功能:微观上,构建裁判事实;中观上,锚定程序以审判为中心;宏观上,推动诉讼构造的持续改善。

The principle of evidence judgment is the key and core of the criminal procedure reform centered on the trial.Its development keeps close connection with guarding against wrongful convictions and reform of criminal procedure centering on trial.Evidence has three traits which are objective reason,subjective reason and procedural reason.Due to this,the principle of evidence judgment has positively related traits which are subjective and objective unity of reason,subjective reason and procedural reason.The function of the principle of evidence judgment in criminal procedure consists of three parts,which are independent and organic.In the micro level,the principle of evidence is the key to the construction of the judgment.On the central view,the principle of evidence judgment ensures that criminal prosecution is centered on trial procedure.On the macro level,the principle of evidence is helpful to the improvement of litigation structure.
