毒品犯罪技术侦查材料在一定范围内存在转化的必要,这既是解决毒品犯罪证明难题的必然要求,也是保护技术侦查措施秘密性和个人隐私的现实需要。在通常情况下,毒品犯罪技术侦查材料可以通过变换证据种类、取证手段、证据形式等方式进行直接转化。在特定情况下,也可通过情况说明、工作说明等途径实现间接转化。实现证据转化规范化的途径包括:完善转化过程的记录规范、最大限度地保障技术侦查材料证据转化内容的完整性、对技术侦查所获取的原始素材或载体进行规范保存、规范证据转化后的庭外核实程序等。

It’s necessary for materials obtained by technical criminal investigation about drug crimes to be transformed within certain range.Because it is not only an inevitable requirement to solve the problem of proving drug crimes,but also a realistic need to protect the confidentiality of technical criminal investigation and individual privacy.Generally,materials obtained by technical criminal investigation about drug crimes can be transformed directly by changing category of evidence,means of obtaining evidence and forms of evidence.In specific situations,it can also achieve indirect conversion through description,statement of work and other ways.In order to normalize conversion of evidence,these means can be adopted:improving record standardization of conversion,making sure a maximum guarantee on the integrity of the content of evidence conversion of materials obtained by technical criminal investigation,preserving normatively the original material or carrier obtained by technical criminal investigation and standardizing extrajudicial investigation procedure after conversion of evidence.
