执行体制机制改革研究——以服务安顺法院顺利通过第三方评估为视角

Research on implementation of institutional reforms——From the perspective of serving Anshun court through third-party assessment

"基本解决执行难"已进入关键期、决胜期,如何顺利通过第三方评估是摆在全国各级法院面前的当务之急。事实上,执行体制机制改革的方向、内容、推进力度将决定"基本解决执行难"成败,"基本解决执行难"工作效果即是对执行体制机制改革的评价结果。因此,论文通过对执行体制机制改革的现状、存在问题及原因分析,以"基本解决执行难"第三方评估为契机,以安顺市两级人民法院执行工作开展的基本情况为样本,提出优化执行体制机制改革建议并进行可行性论证,并服务于安顺市两级人民法院全批次按时优质高效地通过中国社科院牵头的"基本解决执行难"第三方评估验收。

“Basically solving the difficulty of implementation” has entered a critical period and a decisive period.How to successfully pass third-party assessment is a top priority for the courts at all levels in the country.In fact,the direction,content,and promotion of the implementation of the institutional reform will determine the success or failure of “basically solving the difficulty of implementation”,and the effect of “basically addressing implementation difficulties” is the result of evaluating the implementation of institutional reforms.Therefore,this paper intends to analyze the status quo,existing problems,and causes of the implementation of the reform of the institutional mechanisms,taking the opportunity of “basicly solving difficult to implement” third-party assessment as an opportunity,taking the basic situation of the implementation of the work of the Anshun city people’s court as a sample,and presenting optimization.The implementation of institutional reform proposals and feasibility studies,and services to Anshun city,two levels of the People's Court full batch of timely and quality and efficient adoption of the Chinese Academy of Social Sciences led the "basic to solve the implementation of difficult" third party assessment and acceptance.
