]利用2005—2015年美国"337调查"涉案的42个国家面板数据,实证研究"337调查"案件侵权判定的影响因素。研究发现,各国当年拥有的PCT专利、美国授权的专利数、汇率以及美国民主党执政对美国"337调查"侵权率有显著影响。美元贬值、民主党执政将减少美国"337调查"案件判定的侵权率;一国拥有专利数量的增加,反而会导致美国判定更多案件侵权。这一结果表明美国对本国产业的保护意图更加强烈,"337调查"更多意义上是一种不公平的知识产权壁垒。

Using the panel data of 42 countries involved in Section 337 investigation from 2005 to 2015,we made empirically research on the influencing factors of the infringement rate of the cases for Section 337 investigation.The study found that the patents which were granted by the United States,the exchange rate,and the US ruling party has a significant effect on the infringement of the U.S.Section 337 investigation;the devaluation of the US dollar and the government of the Democrat will reduce the infringement rate judged by the US Section 337 investigation case.The increase in the number of patents owned by a country will result in the United States determining more cases as infringed.This result shows that the United States has a stronger intention to protect its own industry.The Section 337 investigation is actually a trade protection under the cover of fair trade.
