全球互联网治理法治化思考

Legalization in Global Internet Governance

互联网创造了人类生活新空间,极大地改变了人们的生活与生产方式,但互联网在给人类生活带来便利的同时,其引发的问题也层出不穷。互联网所引发的问题不是单个主权国家的问题,而是一个全球性的问题,从而给全球治理带来了挑战。基于法治的超国家价值、互联网治理的核心是法律问题以及全球互联网治理对法治的呼吁等因素,法治是全球互联网治理的最佳选择。要实现全球互联网治理的法治化,其基本前提是尊重网络主权,基本原则是主权平等,基本价值是网络安全。

Internet has created a new life space for the human beings,which has enormously changed people's ways of life and production and forcefully promoted life development.It is characterized by a high degree of globalization.On the one hand,it brings convenience for human beings;on the other hand,there occur endless problems initiated by internet.The problems initiated by internet aren't the ones of single sovereignty country,but the ones of the world,which brings challenge for internet governance.Thus the concept of global internet governance emerges.It has to face the issue of model selection.The best choice of global internet governance should be legalization that is also the core of internet governance.Certainly,the basic premise to realize legalization of global internet governance is to respect internet sovereignty;the basic principle is sovereignty equality and the basic value is internet safety.
