An Introduction to the General Principles of Economic Law in China

新兴经济法是国民经济发展法。值此总结改革开放40年成就和经验之际,经济法面临继往开来之格局。本文立足中国实际,紧跟时代要求,在回顾评估经济法异军突起、迅速发展的起点上,论证拟订反映经济法基本形象的经济法通则的必要性、可行性和操作性,并分析其存在的困难,提出期待的创新。以总则、分则、附则的体例,初步设计出由三编、17章共300条组成的建议稿。希望达到三个"确信"的社会效果,即确信经济法已成为一个法律整体,确信经济法真正有自己的专业特色,确信经济法可实现传统法律部门所无法完成的历史使命。

The emerging Economic Law is the law aiming at promoting national economic development.On the occasion of summarizing the achievements and experiences of the implementation of reform and opening policy for forty years,the Economic Law in China needs to go forward.Based on China s status quo and to keep up with the present requirements of the society,this article demonstrates the necessity,feasibility and operability of formulating the General Principles for the Economic Law to reflect the basic framework of Economic Law.It analyzes the existing difficulties and puts forward the expected innovations.Following the general rules,sub-rules and supplementary rules,a draft proposal including three parts,seventeen chapters and a total of 300 articles was preliminarily designed.This article attempts to achieve the three “convinced” social effects,that is,to be sure that Economic Law has become a legal branch as a whole,that Economic Law really has its own professional characteristics,and that Economic Law can fulfill the historical mission that traditional legal departments cannot accomplish.
