目的研究并分析、探讨术前律师见证制度在医疗风险防范中的作用及积极意义。方法通过分析术前律师见证的法律属性、法律效力及合法性,查阅相关文献,并结合我国术前律师见证实施的现状。结果与结论术前律师见证制度可以充分保障患方的知情同意权,维护医患双方的合法权益;提高医疗质量,降低并发症发生率;降低患方期望值,避免医疗投诉和纠纷的发生,从而对医疗风险进行有效的防范和管控。

Objective To inquire into the role and positive effects of the lawyer witness before operations in medical risk prevention.Methods By analyzing the legal nature,legal validity and legality of the lawyer witness before operations,we looked into relevant documents as well as the present situation of the lawyer witness before the operations in our country.Results and Conclusion The lawyer witness before operations can protect the right of patients'informed consent and safeguard the legitimate rights and interests of both doctors and patients,improve the quality of medical treatment and reduce the incidence of complications,so as to lower patient expectations and avoid medical complaints and disputes,so it can effectively prevent and control medical risks.
