转化型抢劫罪的转化条件探究

On Transformation Conditions in the Transformative Robbery

我国刑法第269条规定的犯罪在刑法理论上被称为转化型抢劫罪。转化型抢劫罪的转化条件、犯罪形态等都是刑事法律理论和实践研究的重要内容,有不同观点和争议,本文在学理上对此进行了有益的探究,提出转化型抢劫罪的转化条件由基础犯罪事实——犯盗窃、诈骗、抢夺罪和关联事实——当场以及转化犯罪事实——为了窝藏赃物、抗拒抓捕或者毁灭罪证而使用暴力或者以暴力相威胁构成的观点、理由及相关问题的解决思路,以期对转化型抢劫罪的研究工作的开展有所助益。

The crimes prescribed in article 269 of the criminal law in criminal law theory is known as a transformative robbery. Transformative robbery transformation conditions,such as criminal pattern is an important content of criminal law theory and practice research,there are different views and disputes,this paper has carried on the beneficial exploration about this on the theory,put forward a transformative robbery transformation conditions by the basic criminal facts,theft,fraud,rob sin,and associated facts - on the spot and the transformation of criminal facts,in order to conceal booty,resist arrest or coverup and the use of violence or threat of violence constitute a point of view,the reason and related problem solving ideas,a transformative robbery of the research work in order to help.
