摘要
面对台籍、陆籍劳动者维权案件频发,企业人事管理虚化的客观实际,梳理和分析了我国陆台两岸劳动法保护的异同,对弥补我国大陆劳动立法在配套性、执行性和实效性方面的不足,摆脱其实用价值困境,实现劳动法的重构再生具有重要意义。
Faced with the frequent cases of protecting the rights of Taiwan Residents and mainland workers and the objective reality of the falsification of enterprise personnel management,this paper combs and analyses the similarities and differences of the protection of labor law between China's Mainland and Taiwan in order to make up for the deficiencies in the compatibility,implementation and effectiveness of labor legislation in China's Mainland,get rid of its practical value dilemma and realize the reconstruction of labor law.
