论短期自由刑的缓刑适用

短期自由刑是当今世界各国普遍适用的监禁刑,但由于短期监禁具有一定的弊端,使得对其完善的探索成为必然。刑罚轻缓化的世界潮流和我国刑法结构"严而不厉"的改革方向要求我国扩大短期自由刑的适用,故本文通过考察国外短期自由刑缓刑适用的有关情况,提出我国短期自由刑缓刑适用的完善建议,以克服短期自由刑适用的弊端。

Short-term sentence is a kind of sentence widely applied around the world while unavoidably has its deficiencies.Thus,it is necessary to explore how to complete the application of short-term sentence.The world trend of penalty mitigation and the"strict but not harsh"reform orientation of Chinese criminal law demanding widen the application of short-term sentence.It is meaningful for overcoming the deficiencies of short-term sentencing by the introduction of other countries'relevant circumstances of probation application and putting forward the complete proposals.
