摘要
20世纪80年代中后期,我国竞技体育管理体制改革启动,确立了"运动项目管理中心+全国性单项体育协会"管理竞技体育的同构模式,该模式具有历史合理性和局限性。在公共事务社会化管理和"放管服"改革大背景下,全国性单项体育协会管理体制改革必然选择法治化改革路径。这就要求必须明确全国性单项体育协会权利是来自法律授权和会员权利;作为独立民事主体,全国性单项体育协会必须与运动项目管理中心脱钩,与体育行政部门建立契约型合作关系;通过完善相关法律法规、自主制定章程来明确其权利义务;通过完善委员(理事)会建设,加强会员建设,建立监督机构和健全治理规则来提升其自治能力。
Since the reform of China's competitive sports management system started in the 1980s, the isomorphic model of national sports governing body and national sports association has been established, which have historical rationality and limitations. In the context of socialized management of public affairs and reform of delegating more powers, improving regulation and optimizing services, the reform of national sports association system chooses the path of rule of law inevitably. This requires that the rights of the national sports association must be clearly from the legal authorization and the transfer of the rights of members. As an independent civil subject, the sports association must decouple from the national sports governing body, and establish contractual cooperative relationship with the sports administration. To clarify the rights and obligations of the national sports association by improving relevant laws and regulations and independently formulating articles of sports association. To strengthen the autonomy of the national sports association by improving the construction of committee members, strengthening the construction of members, establishing supervision institutions and improving the governance rules.
