知名商品特有包装、装潢是《反不正当竞争法》保护的法益,其本质上等同于未注册商标,是一项准知识产权,其归属应该遵循知识产权"谁创造谁享有"的基本归属原理。"红罐王老吉凉茶"的包装、装潢是加多宝公司在使用过程中产生的权益,其应该由加多宝公司所有。"王老吉"商标与该特有包装、装潢,无论在形成过程中,还是最后的结果都具有不可分性。然而,二者共同使用"红罐王老吉凉茶"包装、装潢会导致消费者混淆。由于广药集团对"王老吉"商标具有独占性,将该权益归属于广药集团更为妥当,但广药集团必须对加多宝公司基于其对该特有包装、装潢所有的权益进行补偿。
The peculiar packaging and decoration of famous goods is an interest protected by the Unfair Competition Law.It is essentially equivalent to an unregistered trademark.It is a quasi-intellectual property and its attribution should follow the general attribution rule"who creates,who enjoys"of Intellectual Property.The packaging and decoration of"Red Pot Wang Lao Ji Herbal Tea"enjoys the rights and interests arised by th e operation of Jia Duo Bao Corp.,which should be owned by Jia Duo Bao Corp..The trademark of"Wang Lao Ji"and the peculiar packaging and decorationare inseparable both in the course of formation and the final result.However,the common use of the packaging and decoration of"Red Pot Wa ng Lao Ji Herbal Tea"will make consumers confused.Since Guang Yao Corp.has ex clusive rights to the"Wang Lao Ji"trademark,it is more appropriate to make the interests belong to Guang Yao Corp..But Guang Yao Corp.must give Jia Duo Bao Corp.corresponding compensation,Jia Duo Bao Corp.has the rights and interests of the peculiar packaging and decoration.
