中国特色高校学生管理制度的法制进步及其践履——基于《普通高校学生管理规定》的分析

The Progress of the Rule of Law in College Student Management System with Chinese Characteristics——Based on the Analysis of the “Regulations for the Management of Students in General Colleges and Universities”

普通高等学校学生管理规定》是教育部出台的规范高校学生管理的行政规章,是高校学生管理的重要依据和基本制度。在立法宗旨、立法原则、具体内容、程序性规定和法律监督方面的特点体现了中国特色高校学生管理制度的法治进步,但其所蕴含的双重理念、授权性规定和混合法律关系给学生教育管理实践带来了一定困惑。因此,对于其实践问题应当在思维转变、制度完善和文化培育上多下功夫,以进一步推进高校学生教育管理工作的法治化。

The“Regulations for the Management of Students in General Colleges and Universities”is a socialist college student management provision,an administrative regulation promulgated by the Ministry of Education to standardize the management of college students,and is an important basis and basic system for the management of college students.The new features of legislative purposes,legislative principles,specific content,procedural provisions,and legal supervision reflects the progress of the rule of law in college student management systems with Chinese characteristics.The double concept,authorization regulation and mixed legal relationship bring some confusion to education management practice.Therefore,more efforts should be made to change the thinking,improve the system and cultivate the culture,so as to promote the legalization of the management of education for college students.
