摘要
刑法适用公众参与保障机制,能够助益刑事司法倾听公众声音,提升刑事司法的公信力,推动公众法治意识的进步。根据保障范围、内容、价值和层次的不同,可将刑法适用公众参与保障机制区分不同类型。构建新时代刑法适用公众参与保障机制,必须坚持实事求是、多管齐下和统筹兼顾原则,尤其要解决好刑法适用公众参与的信息保障、经费保障、技术保障和责任追究机制等问题。唯有如此,我国刑法适用公众参与的制度设计,方能真正落在实处。
The protection mechanism of public participation in the application of criminal law,which can help the criminal justice to listen to the public voice,enhance the credibility of criminal justice,and promote the progress of the public’s awareness of the rule of law.According to the scope,content,value,level and mode of protection,The protection mechanism of public participation in the application of criminal law can distinguish different types.To construct the public participation guarantee mechanism for the application of criminal law in the new era must adhere to the principle of seeking truth from facts,multi-pronged approach and overall consideration,especially to solve the problem of Information security,Funding guarantee,Technical security and Accountability mechanism for public participation in criminal law.In this way,the system design of the criminal law applicable to public participation in China can be truly implemented.
