论以审判为中心的诉讼制度改革

On the Reform of Litigation System Centered on Trial

以审判为中心是对以侦查为中心和案卷中心主义的纠偏。通过贯彻"直接言词原则"和"证据裁判原则"进而推动庭审内容从形式化走向实质化,推动横向上的以庭审为中心和纵向上的以一审为中心。加强社会公众参与,以司法公开倒逼司法公正,充分发挥庭审预防错判和保障人权的司法功能。司法工作者应当适时革新观念,提升办案能力,以响应党中央的改革决策。

"Centering on trial" is the rectification of "centering on investigation" and "case centralism".Through the implementation of "the Principle of Directness and Verbalism" and "the Principle of Evidentiary Adjudication",we can push criminal trial toward centering on court hearing and the first trial.Besides,we will strengthen public participation in the judicial system so that judicial openness can be the drive for judicial justice and we can make full use of the judicial function of preventing wrongful convictions and safeguarding human rights.Judicial workers should also renew their ideas in a timely manner and enhance their ability to handle cases so as to respond to the reform decisions of the CPC central committee.
