中小学参与构建校园欺暴社会化防治体系职责检视——基于法律规范文本的梳理

An Inspection of Primary and Secondary School Duties in the Socialized Campus Bullying and Violence Prevention System——Based on the Perspective of Legal Norms

摘要 中小学是校园欺凌和暴力社会化防治体系的中心主体,通过对反校园欺凌与暴力法律规范文本的梳理,得出我国中小学防治校园欺凌和暴力职责的基本制度框架已经建立,但存在职责履行配套资源、权力保障制度性匮乏,履行和监督制度标准不明,操作混乱的不足,应当通过制定专门的反校园欺凌和暴力的法律,增加学校有关职责制度的法律供给。 Primary and secondary schools occupy a dominant position in the system of socialized comprehensive prevention and control of school bullying and violence.According to the legal norms,the basic legal framework for the prevention and control of bullying and violence for the primary and secondary schools in China has been established.However,there are many shortcomings in the system that the resources and powers required for the school to perform its duties are lacking,the standards for the performance of duties and supervision are unclear,and the performance of legal responsibility is confused.It should be complemented by the development of a special anti-campus bullying and violence and the enhancement of the legal supply of school-related responsibilities.
