人工智能具有提高法律职业人的工作效率和降低当事人诉讼成本等价值,给法律领域带来一场深刻的变革,影响着法律职业人的生涯。然而,当前的法律人工智能在事实认定和法律推理、法律的正当性等方面存在困境,导致所起的作用有限。因公权力机关的公开性和透明性原则,人工智能在法律职业中只能提供辅助作用。人工智能在未来法律实务中应采用"人类决策、AI辅助"的协作模式,同时建立对法律人工智能的"全程智能监督"模式,明确系统开发者和使用者的责任,深入推进人工智能司法规范化的建设。

Artificial Intelligence(AI)has the value of improving the efficiency of legal professionals and reducing the litigation costs of the parties,bringing a profound change to the legal field and affecting the career of legal professionals.However,the current legal AI has difficulties in fact finding,legal reasoning and legal legitimacy,etc.,resulting in limited role.Due to the openness and transparency of public authorities,AI can only provide an auxiliary function in legal professions.In the future legal practice,AI should adopt the“human decision-making,AI-assisted”collaboration mode.At the same time,we should establish a“full-process intelligent supervision”mode for legal AI,clarify the responsibility of system developers and users,and further promote the construction of standardized AI justice.
