摘要
竞业限制制度对于维护公平的市场竞争秩序,保护用人单位的商业秘密,保护用人单位对新技术新产品开发的投入积极性具有至关重要的意义和作用。但劳动者履行竞业限制义务的同时,其自由择业权也受到了负面影响。因此,需要从设置承担竞业限制的义务主体范围、规定劳动者承担义务的期限、要求用人单位给付合理数额的竞业限制补偿费、设计完整规范的竞业限制协议等方面加以妥善解决。
The competition restriction system is of vital significance and role in maintaining a fair market competition order,protecting the business secrets of employers,and protecting employers'enthusiasm for the investment in new technologies and new products.However,while workers are obligated to fulfill their restrictions on competition,their right of free choice has also been negatively affected.Therefore,it is necessary to properly solve the problem from setting the scope of the obligation subject to the competition restriction,the period of stipulation of the laborer's obligation,the requirement of the employer to pay a reasonable amount of the competition restriction compensation fee,and designing the complete and standardized competition restriction agreement.
