确权过程中土地纠纷防范与化解的实践经验及启示——以北京市大兴区A镇为例

Practical Experience and Enlightenment in Preventing and Resolving Land Disputes in the Process of Confirming Rights— Taking A Town in Daxing District of Beijing as an Example

土地确权颁证是农民心头的"权利定心丸",随着确权工作的全面展开,农地新旧矛盾叠加,纠纷四起,总结确权过程中纠纷防范与化解的典型经验能有效维护农村基层社会的稳定。以北京市大兴区开展土地确权颁证工作的A镇为例,在对其土地确权成效、存在问题及纠纷产生原因进行检视的基础上,总结其将纠纷隐患消除在萌芽、纠纷化解在基层的成功经验和实践案例,提出未来应进一步健全基层农村土地承包经营纠纷调解仲裁体系,加强基层农经机构和队伍建设,推进农村土地承包经营权确权登记颁证成果应用,厘清确权配套政策。

The confirmation and certification of land rights is the"right reassurance"of farmers.However,with the comprehensive development of the confirmation of rights,the old and new conflicts on agricultural land were superposition and disputes were everywhere.It is of great significance to maintaining the social stability at the grass-roots level in rural areas by summarizing the typical experience of preventing and resolving disputes in the process of confirmation of rights.The authors took A town in Daxing district of Beijing as an example to examine the effectiveness of land confirmation,existing problems and causes of disputes,and summarized its successful experience and practical cases of eliminating hidden trouble in the bud and resolving disputes at the grass-roots level,then proposed that we should further improve the mediation and arbitration system of disputes over the contracted management of rural land,strengthen the construction of grass-roots agricultural economic institutions and teams,promote the application of the results of the confirmation,registration and certification of the contracted management right of rural land,and clarify the supporting policies for the confirmation of the right.
