论专利惩罚性赔偿制度建立实施应与我国两步走战略相适应

The Implementation of Patent Punitive Damages System Should be Compatible with China's Two-step Strategy

建立专利惩罚性赔偿制度能发挥激励作用,推动知识产权的创造活动;发挥威慑作用,增加侵权成本。但是当下并不是建立我国专利惩罚性赔偿制度的最佳时期。多数国家专利惩罚性赔偿制度的建立和实施是与国情相适应的。我国专利惩罚性赔偿制度的实施应与我国两步走战略相适应,在两步走战略的第二步,即在2035年到2050年之间,实现社会主义现代化强国的基础上,适时引入专利惩罚性赔偿制度。从科技发展水平上看,在2030年之后,当我国进入创新型国家前列,并逐步成为世界科技强国,那时建立和实施我国专利惩罚性赔偿制度是适宜的。

Establishing a patent punitive damages system can play an incentive role and promote the creation activities of intellectual property rights,play a deterrent role and increase the cost of infringement.But now,it is not the best time to establish apatent punitive damages system in China.For many countries and regions,the implementation of the patent punitive damages system is compatible with their strategy.Therefore,the implementation time of the patent punitive damages system in China should be compatible with the Two-step Strategy.In the second development stage of the two-step strategy,the patent punitive damages system should be introduced on the basis of realizing the socialist modernization power between 2035 and 2050.Considering the level of China’s science and technology,the most suitable time to construct and carry out a patent punitive damages system in China is after 2030,when China will have entered the forefront of an innovative country and realized a socialist modernization power.
