摘要
作为非科学发掘的文物,湖南大学岳麓书院收藏秦简中的法律文献《奔警律》《尉卒律》等首次出现的法律篇章,在经发掘所得、新近公布的睡虎地汉简律典中得到验证;其中一些律令内容,可以用来订正以前对秦律的误解,或者与里耶秦简所见的行政制度相互印证,因而这些简册真实可靠。岳麓秦简法律文献有助于推进秦汉律体系的复原,开启秦令研究的新局面,丰富秦律令的细节性认知,具有重要的史料价值。
As non-archaeologically retrieved artifacts,the legal documents Benjing Lv(“Statutes on Emergency Troops”)and Weizu Lv(“Statutes of the Commandant and Accessory”)which first appeared in the Hunan University Yuelu Academy collection of Qin manuscripts,have now been verified by the recently published Han manuscript statute collection excavated from Shuihudi.The content of these legal documents can be used to correct previous misunderstandings of Qin law,and is corroborated by the administrative system seen in the Liye Qin manuscripts.The Qin legal documents from Yuelu have important historical value in helping to advance the reconstruction of the Qin and Han legal system,open up new aspects for researching Qin ordinances,and enrich our understanding of Qin statutes and ordinances.
