投标文件密封检查问题研究

投标文件的密封对于招标投标活动发挥竞争机制起着重要的作用。法律法规也有若干对应条文,对投标及开标两个阶段的投标文件密封检查及后果有着详细的规定。然而,由于投标及开标阶段各自的侧重点不同,当前的投标文件密封检查存在滥用权利和串通招投标的问题。通过反思提出引入第三方进行检查的问题解决思路,最终创新地提出运用统一的时间点检查,让投标开标两个阶段的投标文件密封检查合二为一,并提出与之匹配的法律条文建议稿。
